EMA-rp, s.r.o. E-SHOP TERMS AND CONDITIONS

I. General provisions

In accordance with the provisions of the Commercial Code, these terms and conditions of business (hereinafter referred to as OP) govern the contractual relations between the seller EMA-rp, s.r.o., Úvalská 593/23, 25101 Říčany, IČO 28496574, DIČ CZ28496574, CR and the buyer through the EMA-rp e-shop , sro

The operator of the e-shop (electronic store) is EMA-rp, s.r.o., Říčany, Czech Republic.

II. Subject of performance

The subject of performance is the agreed delivery of goods via an order from the EMA-rp, s.r.o. e-shop in B2B mode, so the purchase does not include the possibility of returning the goods within 14 days without giving a reason.

III. Registration and purchase in the EMA-rp, s.r.o. e-shop

Only properly registered customers from the Czech Republic can shop in the Czech language interface of the EMA-rp, s.r.o. e-shop.

By sending the order, the buyer agrees to the price of the ordered goods and to the terms and conditions set forth in these Operating Rules. If the buyer orders so-called termed products, i.e. those with an availability date after ordering from the factory, he does so at his own risk and cannot be returned to the seller.

III. Price, payment and shipping

The purchase price is negotiated based on the seller's price list, which is valid on the day the buyer orders the goods. By default, the price is set without VAT.

The goods are dispatched from Monday to Friday via the transport company DPD with delivery on the following working day. To customers without a purchase contract with EMA-rp, s.r.o., the goods are sent on time, customers with a purchase contract pay the value of the goods by transfer order within the period indicated on the invoice. Cash on delivery shipments can be paid to the carrier in cash or by credit card.

If the value of the sent order does not reach 2,500 CZK including VAT, the transport is charged in the amount of 125 CZK including VAT, above this value the transport is free. In the case of transport to Slovakia, Germany, Austria, Poland and Hungary, we charge a transport fee of CZK 350 including VAT, above the order value of CZK 4000 incl. VAT is free shipping.

Ownership of the delivered goods is transferred to the buyer only upon payment of the entire purchase price.

The seller is responsible for the risk of loss, destruction or damage to the goods during transport to the buyer. The buyer is obliged to check the condition of the shipment, the intactness of the packaging and company tapes upon receipt. In case of doubt about the undamaged nature of the shipment, the buyer is entitled not to accept the shipment. If there is damage to the goods during transport and the buyer discovers this fact when handed over by the transporter, he will wait for acceptance, immediately contact the seller and agree on the next course of action.

IV. Delivery time

The delivery date of the goods depends on the delivery time of the order from the EMA-rp, s.r.o. e-shop. Orders received on a working day before approx. 3:00 p.m. will be dispatched the following working day.

The dispatch of the shipment is notified by a message to the buyer's e-mail address on the day of dispatch in the afternoon. In the case of sending cash on delivery, the overdue amount is also communicated. Transport is carried out by the transport company DPD with delivery within 24 hours on working days.

The seller is entitled to fulfill the subject of the contract even partially if, during the processing of the order, some of the ordered items are unavailable. The buyer is informed about this situation by e-mail or telephone.

The seller is not responsible for delays or inability to deliver goods due to force majeure.

In such a case, the seller is obliged to inform the buyer and then has the right to extend the delivery period or withdraw from the contract without liability for damages caused to the buyer by non-fulfillment of the delivery.

VI. Further arrangements

The seller provides the buyer with a warranty for the goods for a period of 6 months from the date of receipt.

Obvious defects must be reported by the buyer to the seller no later than 7 days after receiving the goods. Complaints about the goods are processed by the seller immediately if the replacement goods are in stock. If the goods are not immediately available, the complaint is resolved by agreement with the buyer (advancement of the replacement delivery date, possibly issuing a credit note).

VII. Conclusion

These terms and conditions are valid for the buyer's business dealings through electronic commerce in the Czech language interface (e-shop CZ) of the seller EMA-rp, s.r.o. at the website www.ema.cz.
